These Terms and Conditions govern the use of the website of Skizza the Art Project Jerusalem Gallery (hereinafter referred to as “Skizza”, “we” or “us”), purchases made from Skizza through the website and related payment links, event bookings and donations.
Please read these Terms before placing an order, booking an event or making a donation. Mandatory rights under applicable law remain unaffected by these Terms.

The website may provide information about exhibitions, concerts, lectures, performances, workshops, publishing projects and other activities, and may enable the purchase of tickets, books, goods and services or the making of donations, where those options are offered.

The description of the relevant event, product or service, the information displayed before payment and the order confirmation form part of the terms of that transaction. Transaction-specific terms must be disclosed before purchase and cannot reduce mandatory consumer rights. Any expressly offered, more favourable cancellation terms will be honoured.

Where the website links to an independent seller or event organiser, that party’s identity and role should be clear before payment. These Terms govern purchases from Skizza; an independent third party’s terms govern its own transactions. This does not exclude any responsibility that Skizza has under applicable law.

Eligibility and Use of the Website

To place a paid order or make a donation, you must be at least 18 years old and legally capable of entering into the transaction, or act through a parent, guardian or other duly authorised legal representative. A person acting for an organisation must have authority to do so.

You must provide accurate contact, order and delivery information and use only a payment method you are authorised to use. Please notify us promptly if information needs to be corrected.

You must not use the website for unlawful purposes, submit fraudulent orders, impersonate another person, introduce malicious software, attempt unauthorised access, interfere with website security or misuse another person’s personal data or intellectual property.

We may take proportionate steps to prevent fraud, security incidents or unlawful use, including restricting access or declining a transaction on reasonable grounds. Such action will not remove any entitlement to a refund or other remedy under applicable law.
Orders, Availability and Prices

Before completing payment, please check the selected product or event, date, time, location, ticket category, quantity, delivery or collection method and total amount. Any age restrictions or other material participation requirements will be stated in the relevant offer.

Prices are payable in the currency displayed before payment. The total payable amount, including applicable taxes and mandatory charges, will be disclosed before you confirm the transaction. Any delivery charge will also be disclosed before payment. Any currency conversion or separate fee imposed by your bank or payment provider is governed by your arrangement with that provider.

A booking or order is confirmed when Skizza issues an order confirmation, booking confirmation or ticket, including through an authorised automated system. A payment authorisation or payment-service receipt alone may not establish that a booking has been allocated. If a payment has been taken but the order cannot be fulfilled, we will notify you and refund the amount paid for the unfulfilled order unless you expressly choose an available alternative.

If you do not receive confirmation, or believe that payment was taken more than once, contact us before submitting another payment. We will investigate payment and booking discrepancies and correct any confirmed duplicate or incorrect charge.

We may update future offers, availability and prices. We will not increase the price of a confirmed order without your agreement. If a material error or availability problem affects an order, we will contact you to agree a lawful solution; any proposed substitute requires your consent, and your statutory remedies remain available.
Online Payments through Allpay

Online payments for tickets, books, donations, goods and other services are processed through the Allpay payment service: https://www.allpay.co.il/.

You may be redirected to a secure Allpay payment page or enter payment details in a secure form supplied by Allpay. Available payment methods, the charge currency and any instalment options are those displayed for the particular transaction before payment.

Payment is subject to authorisation by the relevant payment service and financial institution. An unsuccessful or interrupted payment attempt does not by itself confirm an order or reserve a place at an event.

Full bank card details, including the complete card number and security code, are processed directly by Allpay and are not stored by Skizza. We may receive the payment status, amount, date, purpose, transaction identifier and payer information needed to administer the transaction, refunds and accounting records, as described in our Privacy Policy.

Allpay’s own terms, privacy policy and payment-security requirements apply to its processing services. Allpay’s involvement does not replace Skizza as the seller or service provider for a transaction with Skizza and does not reduce our obligations concerning delivery, cancellations or refunds.

We will provide the transaction and accounting documents required by applicable law. A transaction will not create a recurring payment arrangement unless its amount or calculation method, frequency and cancellation terms have been clearly disclosed and separately authorised by you.
Tickets and Attendance

A ticket or booking is valid only for the event, date, time and number of admissions stated in the confirmation. Keep your confirmation and any ticket code secure. Contact us if a ticket is lost or appears to have been used without authorisation.

Admission may require presentation of the ticket or booking confirmation and, where relevant, reasonable proof of eligibility for an age-based, discounted or named ticket. A ticket may not be duplicated or used for more admissions than purchased. Contact us before transferring a named ticket so that any necessary booking details can be updated.

Visitors must follow reasonable venue, safety and accessibility instructions and respect other visitors, staff and performers. Do not touch or handle artworks unless expressly permitted. Photography, recording, food and drink may be restricted in particular exhibition or performance areas where this is communicated.

Admission may be refused or a visitor asked to leave on lawful and reasonable grounds, such as a serious safety risk or disruptive conduct. Any consequences for payment or refunds will be determined in accordance with applicable law; this clause is not a blanket exclusion of refunds.

Please contact us about accessibility requirements or necessary assistance before purchasing where possible. Contact in advance helps us confirm available arrangements but is not a condition for exercising statutory accessibility rights. Late arrival or non-attendance does not, by itself, create an additional refund right beyond applicable law or any more favourable terms offered for the event.
Books, Goods, Collection and Delivery

Product descriptions will identify the material characteristics of the goods offered. For books, relevant details may include language, edition and format. Images are illustrative; ordinary screen-colour differences do not excuse a material mismatch between the goods supplied and their description.

Available delivery areas, collection options, charges and the applicable delivery or collection timetable will be disclosed before payment. Delivery is offered only where expressly available for the particular order. Contact us before ordering if the website does not provide the information needed to confirm delivery to your address.

If we become aware of a material delivery delay or an inability to supply an item, we will notify you and explain the available options. The use of a courier or other contractor does not remove Skizza’s legal responsibility for fulfilment. We will not substitute a different item without your consent.

Please inspect goods upon receipt and tell us promptly about damage, missing items or a mismatch with the order. Providing an order reference and photographs, where available, helps us investigate, but does not create a shorter deadline or additional condition for exercising mandatory rights.
Cancellation Rights for Online Purchases

Consumer cancellations are governed by the Israeli Consumer Protection Law, 5741–1981, and other applicable legislation and regulations. The following provisions describe the principal rules for qualifying distance-selling transactions with Skizza. Different rules may apply to in-person purchases, particular categories of goods or services, or transactions that do not qualify as consumer transactions. Mandatory law prevails over any inconsistent provision below.

For goods purchased in a qualifying distance-selling transaction, you may generally cancel from the date of the transaction until 14 days after receiving the goods or the legally required written transaction information, whichever is later, subject to statutory exceptions.

For an event ticket that falls within the statutory category of leisure or entertainment services, you may generally cancel within 14 days after the transaction or receipt of the required written transaction information, whichever is later. Cancellation must fall outside the seven-day period, excluding statutory rest days, preceding the event. This restriction does not remove rights arising from cancellation by Skizza, non-performance or another breach.

For another one-off service covered by the distance-selling rules, the general cancellation period is 14 days after the transaction or receipt of the required written information, whichever is later, provided cancellation is made at least two days, excluding statutory rest days, before the service is due. Where a continuing service is offered, the applicable cancellation and proportionate-payment rules will apply, including where service has already begun.

A consumer aged 65 or over, a person with a disability or a new immigrant, as defined by law, may have an extended four-month cancellation period if the distance-selling transaction involved communication with Skizza, including by telephone, email or chat. The relevant statutory starting date, service cut-off rules and exceptions still apply. We may request only the eligibility evidence permitted by law.

Statutory exceptions may apply, for example, to goods made specifically to a customer’s special requirements, digital information, or goods capable of recording or reproduction whose original packaging has been opened. We will rely on an exception only where its legal conditions are met. A product is not excluded from cancellation merely because it is described as art, a book, a sale item or a special order.

Where the law permits a cancellation fee for a change-of-mind cancellation, the fee will not exceed 5% of the transaction price or ILS 100, whichever is lower. We will not add a payment-processing or administrative deduction that circumvents this limit. No cancellation fee will be charged where the law prohibits it, including qualifying cancellations for a defect, material mismatch, late supply or another breach by Skizza.

Outside a statutory cancellation entitlement or a more favourable policy expressly offered before purchase, any additional change-of-mind cancellation or exchange requires agreement with Skizza. This does not limit remedies for defective goods, non-performance, misleading information or other breaches.

Include your name and any identification details required by law, together with enough information to identify the transaction, such as the order reference, event name or payment date. An order reference is helpful but is not an additional legal condition for cancellation. Do not send your full card number or security code. Keep a copy or other record of your notice; a valid notice does not depend on our issuing an acknowledgement.

For a valid statutory distance-sale cancellation, we will refund the amount due, cancel any related future charges and provide the required cancellation documentation within 14 days after receiving the cancellation notice, or within any other mandatory period applicable to the transaction. Any permitted cancellation fee or lawful payment for services already provided will be explained.

For a change-of-mind cancellation of goods already received, you are generally responsible for returning them to Skizza at your expense. Where cancellation results from a qualifying defect, mismatch, late supply or other breach by Skizza, make the goods available at the place where they were delivered and we will arrange collection as required by law. Please take reasonable care of the goods; any claim for significant deterioration in value will be handled only as permitted by law.

Refunds will normally be made to the original payment method through Allpay, unless applicable law requires another method or we agree a lawful alternative with you. Store credit or a replacement ticket will not be imposed instead of a monetary refund to which you are entitled. Payment-provider procedures do not extend Skizza’s statutory refund deadlines. Nothing in these Terms restricts lawful payment-dispute or chargeback rights.

Event Cancellation, Postponement and Changes

If Skizza cancels an event, we will notify affected customers using the contact details provided and refund the ticket price and any mandatory booking charges collected by Skizza for the cancelled event, without a cancellation fee. We will initiate the refund promptly and in any event within 14 days of notifying you of the cancellation, unless mandatory law requires an earlier deadline. An alternative event or credit may be offered but will be optional.

If an event is postponed, or its date, venue or essential advertised content changes materially, we will explain the change and offer the choice of accepting the revised arrangements or cancelling for a refund without a cancellation fee. We will not treat silence as acceptance where the law requires express agreement.

Minor programme adjustments that do not materially alter the service may occur. Any legal entitlement to cancel because of a particular change remains unaffected. Skizza will take reasonable steps to communicate material changes promptly.

Security incidents, government restrictions, emergencies or other events outside our reasonable control may affect an event. We will take reasonable steps to notify customers and mitigate disruption. Such circumstances do not automatically remove refund rights. Mandatory legislation or binding emergency measures applicable to the transaction will prevail where they require a different arrangement.
Donations

Where a donation option is offered, a donation is a voluntary contribution to support Skizza’s activities or the particular purpose stated on the donation page. The amount, currency and any specified purpose will be shown before payment.

A genuine donation does not purchase a ticket, product or service unless that benefit is expressly described. A payment that is in substance a purchase will not be treated as a donation merely to avoid consumer rights.

Donations are processed through Allpay. Recurring donations will be charged only following clear, separate authorisation of their frequency, amount or calculation method and cancellation arrangements. Cancellation of future recurring donations does not by itself determine whether an earlier donation is refundable.

If a donation was made in error, duplicated or charged without authorisation, or you wish to request its return for another reason, contact skizze.gallery@gmail.com with the transaction details. We will review the request promptly in accordance with applicable law, any stated campaign terms and the circumstances. This does not restrict your rights against a payment provider.

A payment receipt does not by itself establish that a donation is tax-deductible. Eligibility for a tax benefit depends on the applicable law, the recipient’s relevant approval and the donor’s circumstances. No tax benefit is promised unless expressly confirmed on a valid legal basis.
Intellectual Property and Submitted Materials

Website text, photographs, artwork images, designs, logos, recordings and other materials belong to Skizza or their respective artists, authors or other rights holders. Display on the website does not transfer ownership or grant a general right to reproduce or commercially exploit them.

You may view website materials and make use of them as permitted by applicable law. Reproduction, distribution, alteration or commercial use requiring permission must be authorised by the relevant rights holder. This does not restrict statutory exceptions, including lawful quotation or fair use.

Purchasing a physical artwork, print or book does not transfer copyright, reproduction rights or other intellectual property rights unless this is expressly agreed in writing.

If you send us a proposal, text, image or other material, you confirm that you are entitled to submit it. You retain your rights. We may use the material to review and respond to your submission; any broader publication, exhibition or commercial use will require an appropriate separate agreement or other lawful basis.
Privacy, Communications and Photography

The collection and processing of personal data are described in Skizza’s Privacy Policy, available on the website. These Terms do not replace that Policy or constitute blanket consent to optional data processing.

We may send messages necessary to administer your order, ticket, payment, refund or event arrangements. Promotional communications will be sent only with the required consent or another lawful basis. You may opt out using the unsubscribe option or by emailing skizze.gallery@gmail.com.

Photography or video recording may take place at public events, as described in our Privacy Policy and any event notices. Attendance or acceptance of these Terms is not, by itself, an unrestricted consent to the use of your image. Separate consent will be obtained where required by law, including where appropriate for identifiable individuals or minors.
Website Availability and Responsibility

We take reasonable care to maintain the website and provide accurate information, but temporary interruptions, technical errors or maintenance may occur. If an interruption affects a paid order or booking, contact us so that we can resolve it. An interruption does not cancel our contractual or statutory obligations.

Links to independent websites are provided for convenience. Their content and operation are controlled by the relevant third party. This does not exclude responsibility imposed on Skizza by law, including responsibility for service providers engaged to perform our own obligations.

Each party remains responsible for its acts and omissions to the extent provided by applicable law. Nothing in these Terms excludes liability for fraud, unlawful conduct or any other liability that cannot lawfully be excluded, or limits mandatory rights relating to defective goods, personal injury, privacy, accessibility or consumer protection.
Changes, Governing Law and Disputes

We may update these Terms for future website use and transactions. The updated version will be published on the website with its revision date. A later update will not retrospectively reduce rights under an existing order or donation or change its agreed terms without a lawful basis or your agreement where required.

These Terms and transactions with Skizza are governed by the laws of the State of Israel, without depriving a consumer of any mandatory protection that otherwise applies to the transaction.

Please contact us first if you would like us to help resolve a question or complaint. This is an invitation, not a mandatory step before exercising legal rights. Disputes may be brought before a court with jurisdiction under applicable law; these Terms do not require arbitration or waive statutory remedies.

If a provision is found invalid or unenforceable, it will apply only to the extent permitted by law, and the remaining provisions will continue to apply where legally possible. No provision will be interpreted to waive a mandatory right.
